Concession- Operation rules


What is an API?

First of all, API means Port Integral Administration (API), which is granted by the Mexican government to a Mexican mercantile society through a concession to glide, program, develop, use, and exploit the goods and services of a specific port. An API is autonomous in its operative and financial management, the government establishes its policies and internal procedure. What is a port manager? A port manager is the holder of the concession for the API, who has to:

• Glide, program and execute the necessary actions for the promotion, operation and development of the port, or group of ports and terminals, in order to achieve the most efficiency and competitiveness possible;

• Make good use and explore the goods of the public domain in the port or groups of ports and terminals, and administrate the development zone of the port, in its case;

• Construct, support and administrate the common use infrastructure of the port;

• Construct, operate and explore terminals, seacoasts and port facilities, or, through third parties, by means of contract by partially transferring its rights;

• Provide port services and its connections by itself, or through third party with their respective contracts;

• Give their opinion about the delimitation of the zones and areas of the port;

• Formulate the rules of operation of the port, which will include among others, the port's schedules, the requirements that port service lenders should fulfill and, with the previous opinion of the committee of operation, submit them to the authorization of the Ministry of Transportation and communication;

• Assign the positions of dockage in terms of the rules of operation;

• Operate security services, as well as control the access of goods, people and traffic, vehicles in the terrestrial area of the port enclosure, in agreement with the rules of operation and without prejudice of the powers of the harbor master and the competent authorities;

• Obtain, in the terms agreed by the corresponding regulations and concession holder, income for the use of port infrastructure, the celebration of contracts, the services that are given by it directly, as well as for other commercial activities that they pursue,

• Provide statistical port information.


The port manager will subject himself to a main program of port development that will contain:

• Uses, destinations and ways of operation for the different zones of the port or groups of them, as well as the justification of these,

• The measures and necessary forecasts to guarantee an efficient exploitation of the port spaces, its future development and its connection with the general systems of transportation.
